Alibaba (BABA-US) Sues Pentagon Over "Chinese Military Company" Listing

Alibaba (BABA-US) filed a lawsuit against the U.S. Department of Defense (DoD) on Tuesday, June 23, 2026, challenging its designation as a "Chinese Military Company." The e-commerce and cloud giant seeks to revoke the listing, arguing it "lacks factual and legal basis" and has significantly damaged its reputation and commercial partnerships. Alibaba's ADRs fell over 2% to $102.58 on Tuesday, with a year-to-date decline of 34.13%. The DoD added Alibaba to its expanded list earlier this month, citing the company's alleged involvement in China's "Military-Civil Fusion" strategy through ties with the Ministry of Industry and Information Technology and SASAC. Alibaba refutes these claims, stating its services are for retail and IT, not defense. The designation, which also includes Baidu (9888-HK) and BYD (002594-SZ), restricts future DoD contracts and procurement from listed entities starting 2026 and 2027, respectively. Wuxi Biologics (603259-SS) filed a similar lawsuit on June 11.
