Illinois Delays Digital Asset Tax to July 2027 Under Stipulated Motion

Illinois officials agreed to postpone the state's Digital Asset Tax from January 1 to July 1, 2027, per a joint motion filed October 1 in Sangamon County Circuit Court. The filing requests a preliminary injunction and a stay of the effective date pending resolution. The motion follows a lawsuit by the Chamber of Digital Commerce and the Illinois Blockchain Association against Department of Revenue Director David Harris and Attorney General Kwame Raoul. Both sides seek the same outcome, but the court must still approve the stipulation. Governor JB Pritzker signed the Digital Asset Tax Act in June 2026 as part of the 2027 budget. The law imposes a 0.2% levy on crypto purchases and transfers, collected by brokers such as major exchanges. Lawmakers estimated up to $60 million in 2027 revenue. The delay does not settle the case. The industry groups continue to challenge the tax's constitutionality and enforceability, arguing it applies regardless of whether users realize gains.
